Terms of Service
Last updated: October 2026
Important: PropRadar provides property information for general informational purposes only. We are not a licensed real estate agent, financial advisor, or property valuer. Always conduct your own due diligence and seek professional advice before making any property investment decisions.
Data accuracy warning: All property data, valuations, rental estimates, investment scores, and suburb statistics displayed on PropRadar are computer-generated estimates produced from property-market inputs and proprietary algorithms. They may contain significant errors, be outdated, or not reflect actual market conditions. You must independently verify all information before relying on it for any purpose.
1. Acceptance of Terms
By accessing or using PropRadar ("the Service"), operated by PropRadar Pty Ltd (ABN 80 697 007 140) ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
We may change these Terms at any time. A change takes effect as soon as we post the updated Terms on this page, and the "Last updated" date above tells you when that was. We are not obliged to notify you individually, by email or otherwise, so check this page from time to time if the detail matters to you. Continuing to use the Service after a change means you accept it.
If you do not accept a change, stop using the Service and cancel. Where you have pre-paid for a period you have not used, email support@propradar.com.au and we will refund the unused portion. Two things are carved out of this section and keep their own notice periods: price rises under Section 8.1, and the specific API changes covered by Sections 8A.2 and 8A.7.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PropRadar regarding the Service, superseding any prior agreements or communications.
2. Description of Service

3. Important Disclaimers
Not Financial or Investment Advice
The information provided by PropRadar does not constitute financial advice, investment advice, tax advice, legal advice, or any other form of professional advice. We are not licensed financial advisors, property valuers, real estate agents, or tax professionals. We do not hold an Australian Financial Services Licence (AFSL) and are not authorised to provide personal financial advice. Any decisions you make based on information from our Service are made entirely at your own risk and responsibility.
3.1 Data Accuracy and Reliability
You acknowledge and agree that all data displayed on PropRadar is provided on an "as is" and "as available" basis. We make no warranties or representations whatsoever regarding the accuracy, completeness, reliability, currency, suitability, or timeliness of any data, including but not limited to:
- Property valuations, price estimates, and potential sell prices
- Rental estimates and gross rental yield calculations
- Investment scores, ratings, and rankings
- Suburb statistics, median prices, growth rates, and market trends
- Days on market, vacancy rates, and crime statistics
- Property features, specifications, land size, and floor area
- Sold property prices and sale dates
- Data quality flags and warning indicators
This data is derived from external market records, commercial inputs, and algorithmic calculations. It may contain significant errors, omissions, outdated information, or inaccuracies and may not reflect actual current market conditions. Market inputs may become unavailable, delayed, or incorrect without notice. We do not manually verify individual property data points.
You must independently verify all information displayed on PropRadar through qualified professionals (such as licensed valuers, real estate agents, conveyancers, or financial advisors) before relying on it for any purpose, including but not limited to purchasing, selling, renting, or investing in property.
3.2 Algorithmic Estimates and Limitations
You acknowledge that PropRadar uses proprietary algorithms and external market inputs to generate property information and estimates. These processes:
- May produce incorrect results due to changes in underlying market inputs
- May produce valuation estimates that differ substantially (by 20% or more) from actual sale prices
- May assign investment scores or yield calculations that do not accurately reflect a property's actual investment merit
- May incorrectly categorise property types, features, or market conditions
- May display data for the wrong property due to address matching errors
- Are subject to disruption, errors, and periods of unavailability
Investment scores are relative rankings based on algorithmic analysis and do not predict actual investment performance. Yield calculations assume constant rental income and do not account for vacancy, maintenance, management fees, insurance, rates, or other ownership costs. The term "potential sell price" is an algorithmic estimate and does not represent a prediction, guarantee, or professional opinion of what a property will sell for.
3.3 No Guarantee of Results
We do not guarantee any specific investment outcomes, returns, capital growth, rental income, or other results. Past performance of properties, suburbs, or markets does not indicate future results. Property investment carries inherent risks including but not limited to market downturns, interest rate changes, regulatory changes, tenant risk, and unforeseen property defects. You may lose some or all of your investment.
3.4 Valuation Estimates
Property valuations displayed on PropRadar are rough computer-generated estimates only and must not be relied upon as accurate assessments of property value. These estimates:
- Are generated using automated algorithms and external market inputs that may themselves be inaccurate
- May differ significantly (by 20% or more) from actual market values or professional valuations
- Do not account for property condition, renovations, structural issues, contamination, planning overlays, easements, or unique features
- Do not constitute a formal property valuation under Australian law
- Must not be used for mortgage applications, insurance claims, tax assessments, or legal proceedings
- Must not be used as the sole or primary basis for making purchasing, selling, or investment decisions
3.5 External Market Inputs
PropRadar combines property-market information supplied, observed, or calculated outside our direct control. We are not responsible for errors, omissions, delay, incompleteness, or changes in that information. Availability and accuracy may change at any time without notice to us or to you.
3.6 Assumption of Risk
BY USING THE SERVICE, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT: (A) YOU USE THE SERVICE AND RELY ON ANY INFORMATION OBTAINED THROUGH THE SERVICE ENTIRELY AT YOUR OWN RISK; (B) PROPRADAR SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY LOSSES, DAMAGES, COSTS, OR EXPENSES YOU INCUR AS A RESULT OF USING THE SERVICE OR RELYING ON ANY DATA OR INFORMATION PROVIDED THROUGH THE SERVICE; (C) YOU ASSUME FULL AND SOLE RESPONSIBILITY FOR ANY DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE, INCLUDING ANY FINANCIAL LOSSES, OPPORTUNITY COSTS, PROPERTY LOSSES, OR OTHER DAMAGES THAT MAY RESULT FROM SUCH DECISIONS; AND (D) YOU WAIVE ANY AND ALL CLAIMS AGAINST PROPRADAR ARISING FROM OR RELATED TO THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY DATA DISPLAYED ON THE SERVICE. THIS CLAUSE IS SUBJECT TO THE CONSUMER GUARANTEES IN SECTION 18 AND DOES NOT EXCLUDE OR LIMIT RIGHTS THAT CANNOT BE EXCLUDED UNDER AUSTRALIAN CONSUMER LAW.
4. User Accounts
To access certain features, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use of your account
- Accept responsibility for all activities that occur under your account
By creating an account, you consent to receiving electronic communications from us (including service-related emails, security notices, and updates). You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Marketing communications. By creating an account or purchasing a subscription, you agree to receive occasional marketing emails from us about product updates, promotions, and new features. You can unsubscribe at any time using the link in any email we send, or by emailing info@propradar.com.au. Transactional and security emails (receipts, password resets, service notices) are not affected by marketing unsubscribes.
5. Acceptable Use
This section governs the PropRadar website and apps. If you hold an API key, Section 8A governs what you may do with API responses and prevails over this section where the two differ. Automated access, caching, and local storage are part of what the API is for.
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service
- Use automated systems, bots, crawlers, data-mining tools, or similar processes to access the Service without permission (a current API key is that permission, on the terms in Section 8A)
- Copy, extract, redistribute, resell, bulk download, harvest, or reverse engineer any part of the Service, except as Section 8A permits
- Use PropRadar data, indices, scores, or derived analytics to train machine learning models without our prior written permission (see Section 8A.5 for how this applies to API responses)
- Reproduce, duplicate, copy, sell, or resell any part of the Service
- Interfere with or disrupt the Service or servers
- Impersonate any person or entity
- Use the Service to send spam or unsolicited communications
Violation of these terms may result in immediate termination of your account without notice or refund, and we reserve the right to seek injunctive relief and recovery of losses including legal costs.
6. Community Forum and User Content
PropRadar provides a community forum where users may post content, opinions, and discussions. By posting content on the forum, you:
- Grant us a licence: You grant PropRadar a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, display, and distribute your forum content in connection with the Service
- Accept sole responsibility: You are solely responsible for the content you post. PropRadar does not endorse, verify, or adopt any user-posted content, opinions, or property recommendations
- Warrant your content: You warrant that your content does not infringe any third-party rights and that you have the right to post it
6.1 Prohibited Content
You must not post content that:
- Is defamatory, harassing, threatening, or abusive
- Constitutes spam, advertising, or commercial solicitation
- Infringes copyright or other intellectual property rights
- Contains misleading financial advice or property spruiking/touting
- Violates any applicable law or regulation
- Contains personal information of others without their consent
6.2 Moderation
We reserve the right to remove or edit any content, and to suspend or terminate accounts, at our sole discretion and without notice. We are not obligated to monitor all forum content but may do so. If you believe content violates these Terms or is harmful, please report it to support@propradar.com.au.
Forum posts may survive account deletion as they form part of the community discussion. The licence granted above continues after account closure.
7. Intellectual Property
PropRadar displays proprietary analytics, estimates, indices (including the PropRadar Suburb Index and PropRadar Market Cycle), investment scores, and derived metrics created from aggregated property-market information, public records, listing observations, rental signals, and internal modelling. The Service and its original content, features, functionality, proprietary algorithms, scoring methodology, and derived analytics are owned by PropRadar Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws.
Data you view on the PropRadar website or apps is for your personal use. Commercial use of our data is available through the Developer API on a plan that permits it, and Section 8A sets out what that licence covers, and nothing in this section restricts a customer acting within Section 8A. Where we publish something on its own stated terms, those terms govern it: the embeddable suburb widget at /embed is free to use, including commercially, on the conditions set out on that page.
PropRadar metrics are provided for general information only. They are not official property valuations, financial advice, or a substitute for independent due diligence.
Property listing information displayed on PropRadar may be subject to third-party rights. We do not claim ownership of raw third-party property records or listings.
8. Subscription and Payments
Some features of the Service require a paid subscription. By subscribing, you agree to:
- Pay all applicable fees as described at the time of purchase
- Provide valid payment information
- Automatic renewal of subscriptions unless cancelled before the renewal date
8.1 Pricing and GST
All prices are displayed in Australian Dollars (AUD) and include GST where applicable. We may increase your subscription price by giving you at least 30 days' written notice, sent by email to the address on your account. The new price takes effect at the start of your first billing cycle after the notice period ends, so the price you pay now stands until then.
If you do not want to pay the new price, cancel before it takes effect and you will not be charged the higher amount. Keeping your subscription past that date means you accept the new price. A price increase never applies to a billing period you have already paid for.
8.2 Payment Processing
Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service. We do not store your full payment card details.
8.3 Cancellation
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are provided for unused time within a billing period.
8.4 Refunds
We offer a 14-day cooling-off period for new subscriptions. If you cancel within 14 days of your first payment, you are entitled to a full refund. After the cooling-off period, refunds are provided at our discretion. For a major failure of the Service (as defined under Australian Consumer Law), you may be entitled to a refund regardless of this policy. Contact support@propradar.com.au for refund requests.
8.5 Failed Payments
If a payment fails, we will attempt to process the payment again over the following days. If payment cannot be collected, your subscription may be suspended or downgraded to the free tier. We will notify you by email before any access changes.
8.6 Subscription Tiers
Features available may differ by subscription tier. We may change what is included in any tier at any time, effective when we publish the change, and we are not obliged to notify you individually. Where a change removes something from a paid tier you are currently on, it applies to you from your next renewal rather than immediately. That deferral does not apply to limits we tighten to prevent abuse or to protect the service. Those take effect at once, on every plan.
8A. Developer API
The PropRadar Data API (the "API") is a separate paid service governed by these Terms and the additional clauses in this Section 8A. The current endpoint reference, plan credit allowances, credit costs per operation, burst limits, pagination caps, and deprecation policy are published at /developers/docs (together, the "API Documentation"). The API Documentation forms part of these Terms and may be updated by us as described below.
8A.1 API Keys
API keys are issued per customer account and must not be shared, sublicensed, embedded in client-side code, or used by any party other than the account holder. You are solely responsible for the security of your keys and for all activity performed using them, including any usage, fees, or abuse incurred before you notify us of suspected compromise. We may revoke any key at any time, with or without notice, where we reasonably suspect compromise, abuse, breach of these Terms, or risk to the integrity or availability of the API.
8A.2 Fair Use, Rate Limits, and Throttling
The published monthly credit allowance and per-second burst limit for your plan represent the maximum sustained usage permitted under fair use, not a guaranteed throughput. We may, in our sole discretion, temporarily throttle, queue, degrade, or reject API requests below the published limits where, in our reasonable judgement, usage:
- Threatens the availability, performance, or stability of the API for other customers;
- Exhibits patterns characteristic of automated extraction, enumeration, or systematic harvesting of the data (including, without limitation, repeatedly walking pagination cursors with no observable downstream use, calling the same endpoint with sequentially-varying inputs at high rates, or attempting to defeat per-call pagination caps);
- Originates from infrastructure or networks associated with abuse, fraud, or security threats;
- Exceeds the per-call pagination caps published in the API Documentation, including but not limited to
limit,offset,radius_m,months, or bulk-batch sizes; or - Otherwise conflicts with the spirit of fair use as documented at /developers/docs.
We may change plan credit allowances, the credit cost of an operation, burst limits, pagination caps, or other published fair-use parameters at any time, with at least thirty (30) days' notice for reductions that materially impact your then-current usage. Increases, non-material changes, and changes that solely tighten anti-abuse limits (including, without limitation, lowering pagination caps to industry-standard levels) take effect immediately without notice.
8A.3 Plan Tiers and Commercial Use
Commercial Use of the API requires an API Builder plan or above. Free, Hobby, and Starter keys are licensed for evaluation and for personal, non-commercial projects. They may not be put to Commercial Use at any call volume, and buying a larger non-commercial plan does not change that.
API Builder is a restricted Commercial Use plan, not a smaller Pro. It carries Starter's credit allowance and endpoints, at a price between Starter and Pro, and permits Commercial Use only where you are a small buyer's agency, real estate agency, or similar property-services business using the API to run your own internal tool. It does not extend to a larger organisation. We judge size by the ordinary meaning of the term (staff count, transaction volume, and whether property services are your primary business), not by a fixed headcount, and reserve the right to require an upgrade to Pro or above where we reasonably determine a business does not qualify. Every other restriction in this Section 8A, including Section 8A.5 and Section 8A.6, applies to API Builder the same as any other plan.
Builder, Pro, Growth, and Scale also carry an audience ceiling once your product has real reach, set out in Section 8A.6.
"Commercial Use" means using the API, or what you get back from it, in a business context. That covers:
- a product, service, application, or website you offer to anyone else, whether or not you charge for it;
- work you carry out for a client or an employer;
- tooling a business runs on, such as appraisal, valuation, lead generation, or client reporting; and
- research or modelling done for a commercial purpose.
It does not cover trialling the API to decide whether to buy a plan, learning or experimenting on your own time, or a personal project you earn nothing from and do not offer to others. Building a prototype you have not launched is not Commercial Use; launching it is.
Where we reasonably determine that a Free or Hobby key is being used commercially, we may require you to upgrade and may suspend the key under Section 8A.10 until you do. Plan quotas and pricing are published at /developers. Endpoint access and the commercial-use licence are separate. A plan that permits Commercial Use does not by itself unlock data reserved for a higher tier, and a plan that includes a particular endpoint does not by itself permit Commercial Use of it. Starter includes the bulk and recently-modified endpoints, for example, but you still need API Builder (if you qualify under 8A.3) or Pro to use them in a business.
8A.4 Permitted Use, Caching, and Storage
Subject to these Terms and to your plan permitting Commercial Use where applicable, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable licence to use API responses within your own products and internal workflows. You may cache API responses for performance purposes provided you respect the Cache-Control and ETag headers we set on each response. Cached data must be refreshed at least every forty-eight (48) hours where it can change, such as listing status, asking prices, valuations, and scores; that data must not be displayed to end users as current once it is older than forty-eight (48) hours from retrieval. Records that do not change once published, such as the details of a completed sale, may be kept and shown without a scheduled refresh for as long as your licence lasts.
Keeping a local copy of the records you actually use is expected. It is what the recently-modified feed exists for, and we document the pattern at /developers/use-cases/data-sync. What is not permitted is pulling records you have no downstream use for in order to accumulate the dataset itself.
Your cache is licensed for as long as your subscription is. If your plan ends, whether you cancel, we terminate it, or the account lapses, stop displaying API data within seven (7) days and delete your stored copy within thirty (30) days. You may keep anything you have genuinely derived from it, such as your own scores, notes, client reports, and aggregates, provided our underlying records cannot be reconstructed from what you keep. You may also keep whatever your own record-keeping obligations require.
8A.5 Prohibited Uses
In addition to Section 5, you must not, and must not permit any third party to:
- Resell or redistribute raw API responses, bulk exports, or substantial portions of the API data, whether for fee or free, except as a component of a value-added product that meaningfully transforms the data;
- Train or fine-tune any machine-learning, large-language, or AI model on API responses without our prior written consent. Ordinary analysis of data you have retrieved is permitted, including statistical work, building your own scores, and privately comparing our figures with your own. Passing data you have already retrieved for a specific user's request to a model at inference time is permitted, whether to summarise a property, draft a note, or answer that user's question, provided the responses are not retained as training or evaluation data and are not disclosed to anyone other than that user;
- Reverse engineer the Service, or systematically query the API for the purpose of reconstructing our scoring methodology, valuation models, or ranking algorithms;
- Circumvent rate limits, pagination caps, plan tiers, or any other technical or contractual control, including by opening multiple keys or accounts to get more capacity than one plan allows. Running your own servers from several IP addresses is not circumvention;
- Build a product that Section 8A.6 does not permit;
- Misrepresent the origin, accuracy, or recency of API data to your end users;
- Use the API unlawfully, including to infringe another person's intellectual property or privacy rights, or contrary to a restriction on use that we have notified to you in these Terms or in the API documentation.
8A.6 Products You Build With the API
The licence in Section 8A.4 is for building your own product. It is not a licence to republish our dataset or to rebuild PropRadar and sell it more cheaply.
We are not trying to stop you competing with us. A number of our customers build tools that overlap with ours, and a product that serves property investors is not by itself a breach of these Terms. What this section restricts is substitution: using the API to put substantially our data in front of substantially our audience.
A product is outside your licence if both of the following are true:
- its main function is to search, browse, display, or supply PropRadar data, so that the data is the product rather than an input to it; and
- it is offered to the general public, rather than to identified professional or business users under a subscription, licence, or engagement.
The line matters more than the drafting, so here is how we read it:
- A buyer's agent CRM showing listings, valuations, and days on market next to an agent's own notes: fine. The data supports a workflow you own.
- A lender's or broker's tool that values a book of security properties: fine.
- A public website where visitors search suburbs and read our valuations, free or paid: not fine on a standard plan. That is the Service.
- A "free property data API", a dataset download, or a feed assembled from our responses: not fine at any tier.
That test is about shape, not size. A product can pass it and still grow into something that needs its own agreement: a lender showing our valuations to every loan applicant, or a CRM you sell to other agencies who each put it in front of their own clients. Builder, Pro, Growth, and Scale stay self-serve up to 25,000 people a month seeing PropRadar-derived data through what you build, counted across your whole business rather than per product. Past that, it is a distribution licence, the same one described below, not a bigger self-serve plan. Tell us before you get there.
If you do want to put our data in front of the general public, that is a distribution licence and we price it separately. Ask us. We would rather licence it to you than find it republished.
If we think a product crosses this line, we will write to you saying what specifically concerns us and give you thirty (30) days to change it before we suspend anything. That grace period does not apply where the conduct also breaches Section 8A.5, or where we are required to act sooner.
8A.7 Endpoint Changes and Deprecation
The API is versioned. We may add, modify, or remove endpoints, request parameters, response fields, error codes, or data-quality flag values. For customers on Starter and above, we will give at least thirty (30) days' notice by email before a breaking change to a major version, and at least ninety (90) days' notice before we sunset a major version. On Free and Hobby keys we will give that notice where practical but do not commit to it. Backward-compatible additions (new endpoints, new optional fields, new error codes) and changes required for security, legal compliance, or to stop abuse may be made without notice.
8A.8 No SLA on Standard Plans
The API is provided on a commercially reasonable best-effort basis. No uptime guarantee, response-time guarantee, or service level rebate applies to the Free, Hobby, Starter, Pro, Growth, or Scale plans. A formal service level agreement and service level rebates are available only under a separately negotiated Enterprise agreement. For the avoidance of doubt, a service level rebate is a financial remedy for downtime and is a different thing entirely from the API credits described in Section 8A.9, which are a unit of metered usage with no monetary value.
8A.9 Credits, Billing, and Refunds
Your plan includes a monthly allowance of API credits. Credits are a unit of account for measuring your use of the API. They are not money, have no monetary value, are not redeemable for cash, and are not transferable or assignable. They come with your plan, and you can add credit packs as described below.
Most requests cost one credit. Some operations cost more, because they do materially more work; the current cost of each is published in the API Documentation and returned on every response in the X-Credits-Cost header. We may change the credit cost of an operation on the same notice terms as Section 8A.2.
Credit allowances on a paid plan reset at the start of each billing period, on the date your subscription renews. Allowances on the free tier, and on any plan not billed through a subscription, reset at the start of each calendar month, measured in UTC. Your plan's allowance for a billing period expires at the end of that period. Credit packs bought in addition to a plan are used only once that period's allowance is used up, expire three months after purchase whether used or not, and are priced according to the plan you hold when you buy them. If the account owner turns on auto top-up, we charge the card on the API subscription for the pack they chose, at that pack's price, each time the account's remaining credits fall below 10% of its monthly allowance, no more often than the limit they set for any 30 days. Each charge produces a tax invoice. A declined or unconfirmed charge turns auto top-up off rather than being retried, and the owner can turn it off at any time from the developer dashboard. Unused credits do not roll over and are non-refundable on cancellation, downgrade, suspension, or termination. Credits are deducted when a request is authenticated, and we hand them back where the request did not get a fair answer: a request we reject as invalid, a failure on our side (a 5xx response), a request refused because your plan does not include the endpoint, and idempotency replays and idempotency-key mismatches are all refunded. Where a more expensive operation finds nothing, the extra credits are refunded too. A lookup for a record we do not hold still costs the base credit, so that probing for what exists is never free. A 304 Not Modified response saves you bandwidth but still consumes credits.
8A.10 Suspension
We may suspend or terminate your API access immediately, without notice, where we reasonably believe your use threatens the security, integrity, or availability of the API, involves fraud or key compromise, or where we are required to act by law or by a restriction we are under. We may also suspend access for any other breach of this Section 8A, but for those we will first tell you what the problem is and give you fourteen (14) days to fix it. Section 8A.6 sets its own, longer notice period for questions about what you have built. Suspension does not relieve you of accrued fees, and we do not refund pre-paid fees for a suspension you caused.
8A.11 API Usage Data
We collect and retain logs of your API requests (endpoint, timestamp, status, response time, key identifier, and originating network metadata) for security, billing, abuse detection, and capacity planning. This telemetry is our property and may be used in aggregated or anonymised form for any business purpose, including publishing usage benchmarks and improving the Service. Personal information within this telemetry is handled in accordance with our Privacy Policy.
8A.12 Downstream Compliance and Indemnity
You warrant that your use of the API and any product, feature, or service you build using API responses complies with all applicable laws, including the Privacy Act 1988 (Cth), the Australian Consumer Law, real estate licensing legislation in each state and territory in which you operate, and any anti-discrimination, lending, or financial-services laws relevant to your use case. You will defend, indemnify, and hold PropRadar harmless from any claim, loss, or expense arising from your end users' reliance on API data, your downstream products built on the API, or any breach of this Section 8A, on the terms set out in Section 13.
8A.13 API-Specific Limitation of Liability
In addition to the general limitations in Section 12, and to the maximum extent permitted by law, our total aggregate liability to you for all claims of any kind arising from or relating to the API, regardless of legal theory, shall not exceed the lesser of (a) the total API fees you paid to us in the one (1) month immediately preceding the event giving rise to the claim, or (b) AUD $100. This cap applies in place of the cap in Section 12 to any claim that is wholly or substantially related to the API. Nothing in this clause limits liability that cannot be excluded under Australian Consumer Law (see Section 18).
8A.14 Attribution
Where API data is visible to your end users, attribute it as "Property data provided by PropRadar". Put it on or near the data itself, on the screen, panel, or report where the figures appear, rather than only in a footer or an about page. Plain text is enough. There is no logo to place and no link you have to include.
Enterprise customers are exempt. We will also waive attribution for other customers where it does not suit the surface, but the waiver has to come from us in writing. Ask before you build around not having it.
Two things attribution is not. Do not imply that we endorse, review, or stand behind your product. And do not attribute your own numbers to us: if you adjust, blend, or recalculate a figure we return, present it as yours.
9. Property Tracking and Portfolio Tools
PropRadar provides tools to save properties to watchlists and track owned properties. You acknowledge and agree that:
- PropRadar does not verify the accuracy of property data you enter or track
- Valuations and analytics for your tracked properties are algorithmic estimates only and are subject to all disclaimers in Section 3
- Providing tools to track your property portfolio does not create a fiduciary, advisory, or agency relationship between PropRadar and you
- You are responsible for maintaining your own records, and PropRadar does not guarantee the preservation of your data
10. Analytics and Session Recording
By using the Service, you consent to the collection of usage data and session recordings as described in our Privacy Policy. Session recordings capture your interactions with the Service interface but mask all text input fields by default. We do not record passwords, payment details, or other sensitive form inputs. You may opt out of session recording by contacting support@propradar.com.au.
11. Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. PROPRADAR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY DATA, VALUATIONS, ESTIMATES, SCORES, OR OTHER INFORMATION PROVIDED THROUGH THE SERVICE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPRADAR PTY LTD AND ITS DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, AGENTS, CONTRACTORS, SUPPLIERS, OR AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF USE, LOSS OF GOODWILL, LOSS OF OPPORTUNITY, DIMINUTION IN PROPERTY VALUE, OR OTHER TANGIBLE OR INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content, data, or information obtained from the Service
- Unauthorised access, use, or alteration of your transmissions or content
- Investment, purchasing, selling, or other financial decisions made based on information from the Service, including decisions based on property valuations, rental estimates, yield calculations, investment scores, or suburb statistics
- Errors, inaccuracies, or omissions in property valuations, rental estimates, potential sell prices, investment scores, suburb data, or any other data
- Reliance on algorithmic calculations or external market information that prove to be inaccurate, outdated, or misleading
- Financial losses incurred as a result of property transactions influenced by information displayed on the Service
- Any property purchased, sold, or held based in whole or in part on information from the Service that subsequently declines in value or fails to perform as expected
- Delays, interruptions, or unavailability of the Service or any data
- Any bugs, viruses, or other harmful components transmitted through the Service
Exclusion of liability: To the maximum extent permitted by applicable law, PropRadar accepts no liability whatsoever in connection with the Service. Where liability cannot be fully excluded by law, our total aggregate liability to you for all claims of any kind arising from or relating to the Service or these Terms shall not exceed the total amount you actually paid to us in the one (1) month immediately preceding the event giving rise to the claim. Nothing in this clause limits liability that cannot be excluded under Australian Consumer Law (see Section 18).
No liability for data inaccuracy: Without limiting the foregoing, you expressly agree that PropRadar shall have absolutely no liability for any inaccuracy, error, or omission in any data, valuation, estimate, score, statistic, or other information displayed on the Service, regardless of whether such inaccuracy results from errors in our algorithms, errors in external data, or any other cause.
These limitations of liability apply regardless of the legal theory on which any claim is based, including contract, tort (including negligence and gross negligence), strict liability, statutory liability, or any other theory, and regardless of whether PropRadar has been advised of the possibility of such damages.
13. Indemnification
You agree to defend, indemnify, and hold harmless PropRadar and its directors, officers, employees, partners, agents, contractors, suppliers, and affiliates from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, expenses, or debt (including reasonable legal fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms
- Your reliance on any data, valuations, or information obtained from the Service
- Any content you post on the community forum
- Any claim by a third party related to your use of the Service, including claims arising from property transactions influenced by information from the Service
- Your violation of any applicable law or regulation
14. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by PropRadar. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.
15. Termination and Account Closure
We reserve the right to terminate or suspend your account, your subscription, and your access to the Service. Where you have breached these Terms, or where your use puts the security, integrity, or lawful operation of the Service at risk, we may do so immediately and without notice. Otherwise we will give you at least thirty (30) days' notice by email, and we will refund the unused portion of any subscription you have already paid for. API access is governed by Section 8A.10, which sets its own notice periods and prevails over this section for API keys.
We may also stop offering the Service, or any plan or feature within it, on thirty (30) days' notice. Nothing in this section obliges us to keep any particular plan, price, or endpoint available indefinitely.
You may close your account at any time by contacting support@propradar.com.au. Upon account closure:
- Your right to use the Service will immediately cease
- Active subscriptions will not be renewed, but no refund is provided for the remaining billing period
- Your personal data will be deleted within 90 days, subject to legal retention requirements
- Forum posts you created may be retained as part of the community discussion
- You may request a copy of your data before closure
Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
16. Force Majeure
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, government actions, market-data interruption, internet service failures, cyberattacks, or changes to third-party service availability.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
18. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
Where the Australian Consumer Law applies to you as a consumer and cannot be excluded, our total liability to you for a failure to comply with a consumer guarantee is limited to, at our election:
- Re-supplying the services; or
- Paying the cost of having the services re-supplied.
For a major failure of the Service, you may be entitled to cancel the contract and receive a refund, or to compensation for the reduction in value of the services.
To the extent permitted by law, all other warranties, representations, conditions, and guarantees (whether implied by statute, common law, or otherwise) are excluded.
To the extent any provision of these Terms is found to be an unfair contract term under section 23 of the Australian Consumer Law, that provision shall be severed, and the remaining Terms shall continue in full force and effect.
19. Dispute Resolution
Any dispute arising out of or in connection with these Terms or the Service must first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved within thirty (30) days of written notice, either party may refer the dispute to mediation administered in Melbourne, Victoria. If mediation is unsuccessful, the dispute may be referred to the courts of Victoria, Australia.
20. General Provisions
- Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
- Waiver: Failure by PropRadar to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
- Assignment: PropRadar may assign or transfer these Terms without your consent. You may not assign your rights or obligations under these Terms without our prior written consent.
- Notices: Legal notices to PropRadar must be sent by email to support@propradar.com.au. We may send notices to you via the email address associated with your account or by prominent notice on the Service.
